SMS Terms

These SMS Terms describe how CosignMD, a product of Clarity Health Innovations Inc. ("Clarity," "we," or "us"), uses SMS text messages with physicians and authorized workforce members ("Users") who provide a mobile number, and with patients or contacts who reach a User's CosignMD-hosted office line. These SMS Terms supplement the Privacy Policy and the Terms of Service and, with respect to PHI, are subject to the Business Associate Agreement.

1. Categories of Messages

By providing a mobile number to CosignMD or by claiming an office number through CosignMD, you may receive the following categories of SMS messages:

SMS is not used by CosignMD for marketing or promotional content.

2. Message Frequency

Message frequency varies based on your clinical activity and the volume of inbound patient communications routed to your office line. There is no fixed cap; volume is driven by the events listed in Section 1.

3. Cost

Msg & data rates may apply. CosignMD does not charge for SMS messages, but your wireless carrier may charge you for sending or receiving SMS or data, including in cases where you reply with a keyword such as STOP or HELP.

4. Opt-Out (STOP)

Reply STOP (or any of STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT) to any SMS message from CosignMD to unsubscribe from non-essential SMS. We will send a single confirmation that your number has been unsubscribed.

After opt-out, you may continue to receive transactional messages strictly required for account security and HIPAA compliance (for example, security alerts on a session you initiate) until you delete your account. Account deletion is requested at info@clarityhealthinnovations.com.

To resubscribe, reply START (or UNSTOP, YES) to any CosignMD SMS thread.

5. Help (HELP)

Reply HELP (or INFO) to any CosignMD SMS message for support information, or contact info@clarityhealthinnovations.com.

6. Carriers and Conduit

SMS messages from CosignMD are transmitted via Twilio under a HIPAA conduit relationship. PHI is minimized in SMS content where feasible — for example, the daily biller summary is delivered as a secure link rather than as inline patient content. Carriers (and Twilio as conduit) are not responsible for delayed or undelivered messages.

7. Office Number Holders

If you claim an office number through CosignMD (a "Twilio office number"), inbound calls and texts to that number are processed by CosignMD on your behalf as a Business Associate. Senders who initiate contact with that number consent by initiating contact. Outbound messages you send through CosignMD must comply with the Telephone Consumer Protection Act ("TCPA"), the recipient's prior consent, and applicable state law. CosignMD honors the recipient's STOP request platform-wide: once a phone number has opted out, CosignMD will not deliver further non-emergency outbound SMS to that number through any User's account until the recipient resubscribes.

8. Eligibility and Consent

By providing a mobile number or claiming an office number, you represent that the number is yours, that you are authorized to receive SMS at that number, and that you consent to receive the categories of SMS described in Section 1. Carriers supported include the major U.S. carriers; international delivery is best-effort.

9. Changes

We may update these SMS Terms from time to time. Material changes will be notified by email or through the Service. Continued use after the effective date of an updated version constitutes acceptance of the changes.
